“Books” are in-copyright written works, such as novels, textbooks, monographs, dissertations, pamphlets, compilations of letters and other writings that were published or distributed in hard copy form on or before the date on which the Notice will begin to be sent to class members (the “Notice Commencement Date”). The Notice Commencement Date is January 5, 2009. The term “Books” does not include newspapers, magazines or journals, personal papers such as unpublished diaries or bundles of notes or letters, sheet music, books in the public domain in the U.S. or works authored by U.S. governments.
“Inserts” are content contained in a Book, a government work or a book in the public domain, such as forewords, afterwords, prologues, epilogues, essays, poems, quotations, letters, excerpts, song lyrics, children’s Book illustrations, musical notation, tables, charts, and graphs, and other material. Inserts must be independently protected by U.S. copyright law, and the copyright interest must be held by someone other than the copyright holder of the Book itself. The term “Inserts” does not include pictorial or visual content, such as photographs, maps, paintings, other graphic works or illustrations (except for children's Book illustrations) or works in the public domain in the U.S.
