ITEM, Whereas in an Article of a Statute made << in the Parliament holden at Westminster, the "Monday next after the Feast of St. Hillary, the Thirteenth Year of the Reign that now is, it was "ordained and granted, That no Charter of Pardon "from thence fhould be allowed before any Juftices " for Murder, Death of a Man flain by Await, Af "for "fault, or Malice prepenfed, Treafon, or Rape of a "Woman, if it were not specified in the fame Char"ter. (2) And if any Charter of the Death of Man "were alledged before any Juftices, in which Charter was not specified, that he of whofe Death any fuch was arraigned, was murthered, or flain, by Await, Affault, or Malice prepenfed, the Juftices "fhould inquire, by a good Inqueft of the Vine "where the dead Perfon was flain, if he were mur

(3) And moreover, by the Affent of the Lords in this prefent and a Repeal of Parliament, and at the Prayer of the Commons, he hath ordained and granted, That the Refidue of the faid Article, fhall be wholly out, repealed, and adnulled; that is to fay, If any fue to the King,' &c. [to the End of cap. 1.] (8) because, that the faid Commons of the Realm, fithence have perceived great Grievance of this Ordinance aforefaid, for that many People for Malice have indicted divers Perfons of Murder, Death of a Man flain by Await, Affault, and Malice prepenfed, and Treafon, where in Truth there was no fuch Caufe, to the Intent that no Man <fhould be bold to fue to the King our Lord for fuch. "fhould not be taken at the Mills, Stanks, or elfe-
where, upon the fame Pain: And that no Fifher nor
Garthman, nor none other, of what Eftate or Con-
"dition that he were, fhould not put from henceforth
in the Waters of Thamife, Humber, Oufe, Trent, nor
none other Water of the Realm, by the faid Time,

or of any other Fish whatfoever, may in any wife be
"taken or destroyed, upon the Pain aforefaid. And
"alfo it was rehearfed in the faid Statute, made the
"faid thirteenth Year, that where it is contained in
"the fame Statute of Westminster, that all the Waters,
"in which Salmons be taken in the Realm, fhall be
put in Defence, as to the taking of Salmons, from
"the Day of the Nativity of our Lady, till St. Mar-
"tin's Day; it was ordained and affented in the faid
"Statute made in the faid xiii. Year, That the Waters
"of Lone, Wyre, Merfee, Rybbyl, and all other Wa-Michel
"ters in the County of Lancaster, fhould be put in De-
"fence, as to the taking of Salmons, from the Day of
"St. Michael till the Day of the Purification of our
"Lady, and in none other Time of the Year, becaufe
"that Salmons be seasonable in the faid Waters by the
"Time aforesaid. And that in the Parts where fuch
"Rivers be, good and fufficient Confervators of the
"faid Statute made the faid thirteenth Year fhould be
"affigned and fworn, as it was ordained in the Statute
"of Westminster, and that they fhould punish the Of-

the Pain contained in the fame Statute
"of Westminster, without fhewing any Favour thereof;
"which Statutes have not been hitherto duly executed
"for Default of good Confervators, as our faid Lord
"the King hath perceived by Complaint to him made
in this prefent Parliament:" Wherefore it is ac-
corded and affented, That the Juftices of the Peace
of all the Counties of England thall be Confervators
of the faid Statutes in the Counties where they be
Juftices; and that they and every of them, at all
Times when they may attend, fhall furvey the Of-
fences and Defaults attempted against the Statutes
aforefaid; and alfo fhall furvey and fearch all the
Wears in fuch Rivers, that they fhall not be very
ftrait for the Deftruction of fuch Fry and Brood, but
of reasonable Widenefs after the old Affife ufed or
accustomed; and that the fame Juftices, or any of
them, which fhall find Default or Abuse against the
Statutes aforefaid, fhall make due Punishment of them
which be found in Default after the Content of the
fame Statute. And that the fame Juftices fhall put
good and fufficient Under Confervators of the fame
Statutes under them, which fhall be fworn to make
like Surveying, Search, and Punishment, without
Favour thereof to be fhewed. And moreover,
that the fame Juftices, in their Seffions, fhall inquire
as well by their Office, as at the Information of the
Under Confervators aforefaid, of all Trefpaffès, Mif-
prifions, and Defaults made against any of the Points
aforefaid, and fhall caufe them which be thereof in-
dicted to come before them, and if they be thereof
convict, they fhall have Imprifonment, and make
Fine after the Difcretion of the fame Juftices; and if
the fame be at the Information of any of the Under
Confervators aforefaid, the fame Under Confervator
* fhall have the half of the fame Fine. And forafmuch
as it is granted to the Citizens of London, by the
*King's Progenitors, that they may remove and take
