Ship or other Veffel, or any other Perfon or Perfons whofoever, fhall Docks, &c. pres throw, caft or put away any Ballaft, Earth, Duft, Afhes, Stones vented. or other things, into or upon any of the Works to be made in pursuance of this Act, to the Prejudice thereof, or into the River Thames, in any Place or Places between London Bridge and the Mouth of the River Lea, or do any other Annoyance to the fame respectively, or any Part thereof, and Complaint being made thereof upon Oath, by any Harbour Mafter, Dock Mafter or other Officer, or any other Perfon, the fame fhall be examined into and determined by any one or more of His Majesty's Juftices of the Peace for the County, City or Place wherein fuch Offence fhall be committed, and he or they is or are hereby authorized to impofe upon the Offender or Offenders fuch Fine or Fines, not exceed- Fines, ing ten Pounds, for each Offence, as they the faid Juftice or Juftices fhall think reasonable; and in cafe of Non-payment thereof immediately after the same shall be demanded, it fhall be lawful for any fuch Juftice or Juftices for the time being, by Warrant under his or their Hand and Seal, or Hands and Seals, to levy the fame, together with the Cofts and Charges incident thereto, by Distress Distress, and Sale of the Goods and Chattels of every fuch Owner or Owners, Master or Commander, Seaman or Servant, or other Perfon or Perfons fo offending, or of the Tackle, Apparel or Furniture of or belonging to fuch Ship or Veffel, rendering the Overplus (if any) to fuch Master or Commander, or to the Perfon or Perfons whofe Goods or other Things fhall be fo distrained; and if fufficient Diftrefs cannot be found, then it, fhall be lawful for fuch Juftice or Juftices, by Warrant under his or their Hand and Seal or Hands and Seals, to commit such Offender or Offenders to any Prifon within his or their Jurifdiction, there to be kept to Imprisonment. hard Labour for any time not exceeding thirty Days, unless fuch Penalty fhall be sooner paid.

C. And be it further enacted, That no Owner or Occupier Mills, &c. of any Mill or other Works, that may be hereafter erected or ftanding near the said Canal, or any of the faid Docks, Basons or Cuts, or his Servants or Workmen, or any other Perfon or Perfons by his Direction or Order, or in his Employ, fhall, at any time after the completing of the faid Canal, or any of the faid Docks, Bafons or Cuts, ufe or draw down the Water from any fuch of them as fhall be fo completed, or the Slips or Trenches communicating therewith, without the Licence and Confent of the faid Mayor, Aldermen and Commons, in Common Council affembled, or of the faid Directors, as the cafe may require, and making fuch Compenfation and Satisfaction as may be mutually agreed upon; and that the faid Mayor, Aldermen and Commons, or Directors, their Officers or Servants refpectively, shall and may, from time to time and at all times as Occafion fhall require, cut off fuch Communications of Water on every fuch Trefpafs; and every Perfon fo trefpaffing Penalty. or offending fhall, for every fuch Offence, forfeit and pay any Sum not exceeding fifty Pounds.

CI. And be it further enacted, That all loaded Veffels which fhall go into any of the faid Docks or the Bafons or Cuts which may belong thereto, fhall unload and discharge their respective Cargoes as foon as conveniently may be after entering therein, and Regulations fhall then, without Lofs of time, be removed into fuch Part

of the faid Docks and other Works as fhall be fet apart for light Veffels; and the faid Dock Mafter and Dock Masters are refpectively hereby authorized to order and caufe to be removed and taken out of the faid Docks, Bafons and Cuts, or any of them, all fuch light Ships or Veffels as are unfit for Service, or not intended to be loaded or fitted out for the Weft Indies; and to the Intent that the Dock Matters may have Knowledge of fuch Ships fo circumstanced, the Mafter or Owner of every fuch Ship or Veffel fhall, within fix Weeks after fhe fhall have entered any of the said Docks, give Notice to the faid Directors, that fuch Ship or Veffel is unfit for Service, or is not intended to be loaded or fitted out for the West Indies, as the cafe may be, or on Failure therein, fhall forfeit and pay any Sum not exceeding twenty Pounds; and in cafe any Mafter or Owner or Owners, or other Perfon having the Charge or Command of any fuch Ship or Veffel as last aforefaid, fhall refuse or neglect to remove fuch Ship or Veffel from fuch Part of the faid Docks and other Works as shall be set apart for light Veffels, within forty eight Hours after Notice in Writing fhall be given to fuch Mafter, Owner or Owners, or other Perfon refpectively, then and in every such case he or they shall forfeit a Sum not exceeding ten Pounds nor less than five Pounds; and the Dock Mafter or Dock Masters, his or their Affiftant or Affiftants, may remove or cause to be removed, fuch Ship or Veffel out of the faid Docks and Bafons or Cuts, or any of them, and lay or moor the fame in fuch Part of the River Thames withinLow Water Mark, as shall be directed by any Harbour Master appointed in pursuance of this Act, upon Application made to him for that Purpose, or in any other of the faid Docks and Charges thereof, Bafons; and that upon the Demand of Payment being made by on Non-payment fuch Dock Mafter or Dock Mafters, Affiftant or Affiftants, from levied by Difthe Owner or Owners, Mafter, Commander or Agent of any fuch Ship or other Veffel, of the Charges of removing and mooring the fame (fuch Charges and Expences being firft allowed by the faid Directors); and upon Neglect or Refufal of Payment of fuch Charges fo allowed as aforefaid immediately, the fame fhall be recoverable by Diftrefs and Sale of fuch Ship or Veffel, or her Tackle, Apparel or Furniture, or any Part thereof, rendering the Overplus (if any) after deducting the Charges of taking, keeping and Sale of fuch Distress, to the Owner or Owners Mafter, Factor or Agents, of or for fuch Ship or Veffel, upon the fame being demanded.

CII. And be it further enacted, That all fuch Ships, Lighters, Gunpowder, &c. Barges, Boats and other Veffels, as fhall refpectively have on board any Gunpowder, exceeding the Quantity of one Pound, fhall, refpectively, before they enter any of the faid intended Docks, or of the Bafons and Cuts which fhall belong thereto, land and discharge all their Gunpowder, and unload and clear their Guns; and that no Tar, Pitch, Rofin, Hemp, Flax, Faggots, Furze, Turpentine, Oil, Hay, Straw, Tallow, Greafe, Shavings of Wood, or Combustible Matter of any Kind, fhall be fuffered to be or remain on the Quays or Wharfs intended to be built in or near the said Docks as aforefaid, or any Part thereof, or upon the Deck of any Ship or other Veffel in the faid Docks, Bafons and Cuts, or any of them, above the Space of twelve Hours; and that in cafe the Owner or Owners of fuch Goods, Matters or other Things,

CIII. And, for more effectually preventing Accidents by Fire Fire, Candles, in the faid Docks and Dock Premifes, be it further enacted, That &c not lighted no Person whofoever shall have or keep, or caufe to be had or kept, in Docks, &C. any Fire, Candle or Lamp lighted within any of the faid Docks, or of the Bafons, Cuts, Quays, Wharfs, Warehouses and other Works which fhall belong thereto, at any time or times whatsoever, (except only neceffary Lamps by the Sides of Ways without the Dock Walls, and fuch Fires or lighted Candles or Lamps as fhall be neceffary to be used in the making, building, finishing, repairing, altering or improving of the fame Docks, Bafons, Cuts, Quays, Wharfs, Warehouses and other Works, or any of them) upon Pain of forfeiting for every fuch Offence a Sum not exceeding ten Penalty. CIV. And be it further enacted, That if any Perfon or Perfons Setting Fire to whofoever shall wilfully and maliciously fet on Fire any of the Works or Vef. Works to be made by virtue of this Act, or any Ship or other fels in Docks, &c. Veffel lying or being in the faid Canal, or in any of the Docks, Benefit of ClerFelony, without Bafons, Cuts or other Works to be made by virtue of this Act, gy; otherwise every Person fo offending, in any of the faid cafes, fhall be ad- wilfully damagjudged guilty of Felony, without Benefit of Clergy, and every ing Works, &c. fuch Felon fhall be fubject and liable to the like Pains and Penalties as in cafes of Felony, without Benefit of Clergy; and if any Perfon or Perfons fhall knowingly, wilfully or maliciously demolish, break down, cut or deftroy any of the Works to be made by virtue of this Act, or any Ship or Veffel lying in the faid Canal, or in any of the faid Docks, Basons, Cuts or other Works, then every such Offender being convicted thereof, fhall fuffer Punishment by Fine, Imprifonment or Transportation, Punishment. at the Discretion of the Judge or Judges before whom fuch Offender or Offenders fhall be tried and convicted.

CV. And be it further enacted, That in cafe any Perfon or Deftroying Perfons whofoever fhall wilfully or maliciously cut, break or in Mooring Ropes any manner destroy any Rope or other thing, by which any Ship of Ships. or other Veffel lying in the faid Canal, or in any of the faid Docks, Basons or Cuts, or in any Place or Places in the River Thames, between London Bridge and the Mouth of the River Lea, fhall be moored or fattened, fuch Perfon or Persons fhall, for every fuch Offence, forfeit and pay a Sum not exceeding ten Penalty. Pounds: Provided always, That nothing herein contained shall hinder or reftrain the Harbour Masters and Docks Masters to be appointed in pursuance of this Act, or any of them, or their or his Affiftant or Affiftants, from exercifing in a due and reafonable manner any of the Powers or Authorities hereby vested in them or him refpectively.

CVI. And be it further enacted, That if any Perfon or Perfons Breaking or fhall fteal, damage, break, demolish or throw down, any Lamp extinguishing or Lamps, Lamp Irons or Pofts, which fhall or may be fet up near unto and about the faid Canal, Docks, Bafons and Cuts refpectively, or any of them, or near unto and about any Buildings which fhall in purfuance of this Act be erected on or near the faid Canal, Docks, Bafons or Cuts, or any of them, or shall wilfully extinguish

the Lights within the fame Lamp or Lamps, or damage the Iron or other Furniture thereof, it shall be lawful for any Perfon or Per fons whomfoever, who fhall fee fuch Offence committed, and also for any other Perfon or Perfons, to arrest the Offender or Offenders by Authority of this Act, and without any other Warrant, to convey him, her or them into the Cuftody of a Peace Officer, in order to be taken before any Juftice or Juftices of the Peace, for the County or Place wherein the Offence shall be committed; and that fuch Justice or Juftices fhall proceed to examine upon Oath any Witness or Witneffes who fhall appear to give any Information touching fuch Offence, (which Oath the faid Juftice or Juftices is or are hereby authorized and required to administer) and that if the Party or Parties accused fhall be convicted of fuch Offence, either by Confeffion or by the Teftimony of any credible Witness or Witneffes as aforefaid, he, fhe or they shall forfeit and pay a Sum not exceeding forty Shillings for each Lamp, Lamp Iron or Poft, or other Furniture fo broken, thrown down or damaged, or for every Light extinguished as aforefaid, and moreover fhall make full Satisfaction to the faid Mayor, Aldermen and Commons, in Common Council affembled, or to the faid Company, as the cafe may be, or to fuch Perfon as shall be duly appointed to receive the fame, for the Damage fo done; and that in cafe fuch Offender or Offenders fhall not, on Conviction, pay fuch Forfeiture, and make fuch Satisfaction as aforefaid, fuch Juftice or Juftices is or are hereby required to commit him, her or them to any Prison within the Jurifdiction of fuch Juftice or Justices, for any time not exceeding thirty Days, and that fuch Offender or Offenders fhall not be difcharged before the Expiration of the time for which he, fhe or they fhall be fo committed, unless fuch Forfeiture and Satisfaction fhall be fooner paid and given.

CVII. And be it further enacted, That the Mafter, or Owner or Owners of any Ship, Lighter, Barge, Boat or other Veffel, or of any Raft or Float of Timber, fhall be and is or are hereby made anfwerable for any Damage, Spoil or Mischief that shall be done by any fuch Ship, Lighter, Barge, Boat or other Veffel, or Raft or Float, or any of the Seamen, Boatmen, Watermen or others, belonging to or employed in or about the fame, unto the faid Canal, or any of the faid intended Docks, Basons or Cuts, or unto any of the Bridges, Locks, Dams, Quays, Engines or other Works, in, upon or belonging to the fame, or any of them, or unto any of the Trenches, Aqueducts, Sluices and Paffages to be made as aforefaid, or by loading or unloading any Ship, Lighter, Barge, Boat or other Veffel, or for any Trefpafs or Damage that fhall or may be done to the Owners or Occupiers of any Buildings, Erections, Mills, Dams, Weirs, Lands or Tenements, adjoining or lying near the faid Canal, or any of the faid Docks, Bafons and Cuts, by leaving open Gates or otherwife, or any other Trespass what foever; and the faid Mafter or Owners of any fuch Ship, Lighter, Barge, Boat or other Veffel, or Raft or Float, may be fued by Action for the fame in any Court of Record; and if a Verdict or Judgment fhall be given against him or them, on Proof made, or by Default or upon Demurrer, the Plaintiff or Plaintiffs, in any fuch cafe, fhall recover his or their Damages thereby fuftained, with full Cofts of Suit; and in cafe the Mafter, or Owner or Owners of any fuch Ship, Lighter,

Barge, Boat or other Veffel, or Raft or Float as aforefaid, fhall be compelled to pay any Penalty, or to make Satisfaction for any Damage or Trefpafs, by reafon of any wilful Act or Default done or committed by his Servant or Servants, every fuch Servant or Servants fhall be liable to pay fuch Penalty, or the Money paid for any fuch Damage or Trefpafs to fuch Mafter or Owner or Owners; and in cafe of Non payment thereof, on demand, the same fhall and may be recovered by fuch Mafter, or Owner or Owners, in like manner as any Penalty is hereby directed to be recovered. CVIII. And be it further enacted, That it fhall be lawful for Power to Comthe faid Mayor, Aldermen and Commons, in Common Council mon Council to affembled, from time to time, to make, ordain and establish fuch Bye-Laws, Rules, Orders and Regulations for the good Govern- Cana, excepting ment of the faid Harbour Mafters, and of all Clerks, Treasurers, Docks and Ap Collectors, Engineers, Surveyors, Workmen, Watchraea, Ligh- purtenances. termen, Labourers and others, to be appointed and employed by them the faid Mayor, Aldermen and Commons, in Common Council affembled, under or by virtue of this Act, and for the better regulating, governing and managing of the feveral Works, Matters, Accounts and Things by this Act authorized and directed to be made, done and performed by them, as well whilft the fame are doing as after they fhall be finifhed and completed, and for the more fafe and convenient navigating, placing, mooring, unmooring and removing of Ships and other Veffels on the River Thames, in and near the faid Port, and in the faid Canal, and the Bafons which may belong thereto, (excepting the Docks, Bafons, Cuts and other Works which fhall belong to the faid Weft India Dock Company, and fuch Parts of the River Thames, at Limehoufe Hole and Blackwall aforefaid, as shall be within the Distance of two hundred Yards from any Entrance, out of the faid River there, into the fame Works) and for the better governing and regulating of all Mafters of Veffels, Pilots, Lightermen and others, within the faid Port, and the faid Canal and its Appurte nances, (except as before excepted) and for preventing Damage being done to Shipping, Lighters and Craft, or to any Goods, Wares or Merchandize, by the iffuing of Water from Houses or Buildings, and fuch other lawful and reasonable Bye-Laws, Rules, Orders and Regulations, as they hall deem neceffary and expe dient for the due Execution of this Act, fo as the fame refpectively be not contrary to nor inconfiftent with this Act, or any of the Regulations enacted hereby, or by any other Act or Acts of Parliament in force at or immediately before the paffing of this Act, and not hereby repealed or altered; and alfo from time to and to repeal, time, as they fhall fee Occafion, to repeal, annul, add to, amend &c. the same. and alter fuch Bye-Laws, Rules, Orders and Regulations, or any of them, in fuch manner as to them the faid Mayor, Aldermen and Commons, in Common Council affembled, fhall feem meet or requifite; and to fix and appoint reafonable pecuniary Penalties, and to fix Penal not exceeding forty Shillings, for the Non-obfervance, Non-per- ties for Nonformance, or other Breach of fuch Bye-Laws, Rules, Orders and biervance. Regulations, or any of them; and the faid Mayor, Aldermen and Bye-Laws Commons, in Common Council affembled, fhall caufe fuch of the printed and dif, faid Bye-Laws, Rules, Orders and Regulations as they fhall think fit, to be printed and diftributed in the Port of London, and affixed upon or near fome publick and confpicuous Parts of the Quays or VOL. XX.
